1. Acceptance of Terms

By accessing or using BackTo2D ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

BackTo2D is an AI-powered web application that transforms user-uploaded photographs into 2D cartoon-style avatar illustrations. The Service operates on a credit-based system where users purchase credits to generate images using third-party AI models.

3. User Accounts

• You must create an account to purchase credits and generate images.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years old to use this Service.
• You agree to provide accurate and complete registration information.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits & Payment

• 1 credit = 1 generated image. Credits are deducted when image generation begins.
• Credits are priced in USD and processed via Stripe secure payment.
• Credits never expire and remain in your account until used.
• Credits are non-transferable between accounts.
• All purchases are final subject to our Refund Policy.
• Free or promotional credits have no monetary value and are not refundable.

5. User-Uploaded Content

• You retain ownership of the photos you upload to the Service.
• You grant BackTo2D a limited, non-exclusive license to process your uploaded photos solely for the purpose of generating your requested avatar images.
• We do not permanently store your uploaded photos. Photos are processed in-memory and discarded after image generation is complete.
• You are solely responsible for ensuring you have the rights to upload any photo to the Service.
• You must not upload content that is illegal, abusive, or violates the rights of others.

6. Ownership of Generated Images

• You own the generated images produced from your uploaded photos.
• Starter Pack: Generated images are for personal, non-commercial use only.
• Meme Lover & Pro Avatar Pack: Full commercial usage rights are granted for all generated stickers and avatars.
• You may use commercially licensed images on merchandise, social media ads, websites, and other commercial applications.
• BackTo2D retains no ownership claim over your generated images.

7. Acceptable Use

You agree NOT to:

• Use the Service to generate deepfakes, misleading content, or content intended to deceive or harm others.
• Upload photos of other people without their consent.
• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, scrape, or exploit the Service or its underlying AI models.
• Resell or redistribute credits or accounts.
• Use automated scripts or bots to access the Service in an unauthorized manner.

8. Disclaimers

• The Service is provided "as is" without warranties of any kind, either express or implied.
• AI-generated results may vary. We do not guarantee specific artistic outcomes, likeness accuracy, or quality levels.
• Service availability is not guaranteed. Maintenance, AI provider outages, or other factors may cause temporary unavailability.
• We are not responsible for any loss of credits due to account compromise or unauthorized access.

9. Limitation of Liability

To the maximum extent permitted by law, BackTo2D and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Refund Consequences & Anti-Abuse Policy

Refunds are processed in accordance with our Refund Policy. By requesting or receiving a refund, you acknowledge and accept the following consequences:

• Full Credit Deduction: Upon refund, the entire credit amount associated with the refunded purchase will be deducted from your account — regardless of how many credits remain. Your balance may become negative.
• Negative Balance Lock: If your balance becomes negative after a refund, you will be unable to generate any new images until you purchase additional credits to bring your balance above zero.
• Asset Revocation: All images generated using credits from the refunded purchase will be permanently locked. Locked images will appear blurred in your gallery and cannot be downloaded or used for any purpose.
• Ownership Termination: Upon refund, you forfeit all ownership rights to images generated with the refunded credits. These assets are considered property of BackTo2D and may not be reproduced or distributed.
• Anti-Fraud Enforcement: Accounts that exhibit patterns of abuse (e.g., bulk generation followed by immediate refund requests) may be permanently suspended. We reserve the right to deny refund requests from accounts flagged for suspicious activity.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Unused credits in your account at the time of termination are subject to our Refund Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.
